Legal Separation, Separation Agreements & Divorce Trials

North Carolina Separation Agreement Lawyers

There are essentially two ways to sort things out when legally separating and preparing for divorce. The first is to negotiate a settlement agreement. If negotiation isn't a possibility, the second option is to file a lawsuit and let a judge make the final decision.

To use a football analogy, a separation agreement is like throwing a long toss down the field. It gets you close to the goal in the fastest way possible, provided the receiver catches the ball. A lawsuit is like running the ball. You can still move forward, but it's going to be slower and there are more obstacles to overcome along the way.

At Weaver, Bennett & Bland, P.A., in Matthews, we have more than 30 years of experience helping people in Union County and the Charlotte area. We know how to quickly analyze your case and determine the course of action that is going to be best in your case.

Separation Agreements

Separation agreements tend to be a smart way to resolve all issues. They are usually less expensive and less time consuming. They create less animosity, meaning they are particularly beneficial when children are involved.

There may still be a lot of back and forth. Time may be required to reach compromises. If you get stuck on a particular issue, you can go to mediation to resolve it. Still, we encourage this option whenever it is reasonable.

Filing a Lawsuit

The fact of the matter is that a separation agreement will only work if the other side is going to sign it. If the other side is simply not willing to work with you and wants to fight, there is no sense investing any time in creating a separation agreement. Instead, we will prepare to go straight for the lawsuit.

Divorce litigation is expensive and risky. Your welfare and that of your children will be decided by a judge who has only known you for a few hours. However, if it is in your best interest to go to court, our attorneys serve as powerful advocates.
